Watchtower Beta Terms

These terms add to the Ockham Labs Inc. Terms of Service (the "Terms") for anyone who buys or uses Watchtower. Where they conflict, these terms apply to Watchtower.

1. Experimental beta.

   Watchtower is an experimental beta. It is provided as is and as available, may change or stop at any time, may produce wrong or incomplete findings, and is used at your own risk. Section 14 of the Terms (disclaimers) applies in full.

2. You approve every change.

   Watchtower reads your cloud with access you grant and can revoke. It proposes changes only as pull requests. You are responsible for reviewing, approving and merging them, and for the results of any change you merge or make.

3. Runs in your subscription.

   A customer-hosted install runs in your own Azure subscription. You pay its Azure resource and AI usage costs directly to Microsoft, and you're responsible for that subscription's access, security and backups. We have no access to it. What the install sends to us is described on the Watchtower page.

4. Limitation of liability.

   To the fullest extent permitted by law, our total liability for all claims relating to Watchtower is limited to the Watchtower fees you paid us in the 2 months before the event giving rise to the claim, and our sole obligation is to refund those fees. We are not liable for any other loss, including outages, data loss, security incidents, cloud costs, lost profits, or the result of any change made to your systems. This replaces section 15 of the Terms for Watchtower. It does not limit liability that cannot be limited by law.

5. Licence, service and cancellation.

   The licence is a one-time fee of $199. The optional service is billed monthly and can be cancelled at any time; without it, the install receives no new releases and no new GitHub issues or pull requests. Azure Marketplace purchases are billed by Microsoft under the Marketplace terms. You remove the install by deleting its resource group.

6. Everything else.

   All other sections of the Terms apply, including governing law (Ontario).
